The person whose name appears on the Booking Form agrees to take full responsibility for ensuring that all members of the party adhere to the Conditions as set out below.

In these Terms and Conditions, “you” and “your” refers to all persons named on the booking. “We”, “us” and “our” all refer to the “Owners” Imperium Boat Hire.

These terms & conditions are applicable to direct bookings made through this website.  City break bookings made through AirBnB  are subject to the T’s & C’s of the portal as specified.

1. Making A Booking

By making a booking you are confirming that you are authorised to do so on behalf of all persons named in the booking and you are acknowledging that all members of your party agree to be bound by these Booking Terms and Conditions.

Bookings are made online through our website or email.

Bookings will be accepted from persons over 21 years of age.

When your booking has been made a confirmation will be sent to you by email using the email address that you have supplied.

You should carefully check the details of your confirmation as soon as you receive it. You must contact us immediately if any of the details are incorrect or incomplete.  We cannot accept liability for any inaccuracies that are not brought to our attention within seven days of issuing your confirmation, nor can we accept responsibility for inaccurate information that you have supplied.

Various information regarding the boat is included on our web site. You will be deemed to accept this information which is given in good faith.

2. Paying for your booking

You must pay a non refundable Booking Deposit of 25% on booking, with the remainder of the balance payable no later than four (4) weeks before the beginning of your stay. If a booking is made less than 4 weeks before your stay then the full amount is due at time of booking.

A reminder of final balance will be sent by email, text or phone call five weeks before your stay.

Unless stated as part of your booking, additional items such as (but not limited to) the cost of travel expenses including rail fares, car parking and taxis are not included in the price of your stay.

3. Cancellation By You

We will treat non-payment of the full amount when due as cancellation by you.  If you decide to cancel the booking, you must advise us immediately. Depending on the timing of the cancellation, you will be responsible for Cancellation Charges as detailed below. The date we receive notice shall be the effective cancellation date.

  • Cancellation more than 4 weeks before the start of your stay: Loss of Booking Deposit.

  • Cancellation less than 4 weeks & during your stay: Loss of 100% of the total price.

4. Cancellation By Us

We may cancel your booking under certain circumstances, being:

  • Bookings made by under age persons or anti-social groups.

  • Non payment of amounts due by the due date.

  • Adverse weather or canal conditions, canal closure or disruption.

  • Mechanical breakdown of the boat.

  • Health problems of the crew.

  • Circumstances beyond our reasonable control and predictability.

If cancelled after commencement of your stay, the refund will be pro-rata to the number of days after cancellation.

During your stay, if behaviour by any guest is considered by us to be anti-social, cause harm to others or as a result of malicious damage, we may terminate your booking immediately and apply cancellation charges.

5. Security Deposit

A Security Deposit of £150 can be requested when full balance is due. This is to secure against damage to property throughout the duration of your stay.  This Security Deposit will be refunded in cash to the Booking Owner on successful inspection of the boat upon departure. Specifically, attention will be given to the operation of the flush toilets, which can only be used in accordance with instructions on board.

6. Price Changes

We reserve the right to alter the price of unsold breaks at any time. The price of your chosen break will be confirmed when your booking is made and, with the exception of any errors, we will not change this price once it has been confirmed. We reserve the right to correct any errors in advertised and confirmed prices and will do so as soon as we become aware of an error.

7. Disabilities, Illness and Medical (including dietary) Problems

We will do our best to cater for any special requirements you may have. Should any member of your party have any medical issue or disability which may affect your stay with us, you must provide full details at time of booking so we can advise you of the suitability of the boat to cater for your needs.

We regret we are unable to accommodate a full spectrum of impairment due to restricted access aboard and limited disabled facilities. If we are not advised in advance and find it necessary to cancel your booking at a later date then cancellation charges may be due.

We will not be held liable for personal injury or death during the stay unless directly caused by our negligence.

8. Special Requests

You must make us aware of special requests at the time of making a booking. We cannot guarantee a request unless advised in this way. For guests´ protection, you should ensure that such requests and our reply is in writing (letter or email). We will do our utmost to cater for all requests.

9. Operators Right To Termination.

We reserve the right to decline a booking without assigning any reason for so doing. We reserve the right to terminate a passengers’ cruise should the person in our opinion have placed the boat, its equipment or other passengers in danger of damage or injury by ignoring safety advise or instructions of the crew. We also reserve the right to terminate the cruise of any passenger who, in the opinion of the Skipper, behaves in a manner disruptive to the other canal users. Any refund of the price of the holiday paid would be entirely at our discretion.

The Skipper is in complete charge of the boat and is responsible for its safe navigation. Due to the nature of the vessels and the dangers posed if the navigation is incorrectly used, the Skipper s instructions MUST be followed if the client is in any way involved in passage making. Failure to comply with specific commands of the Skipper will be viewed as a deliberate breach of Health & Safety / Operating Procedures and the Skipper has the power to curtail the charter if he / she sees fit.

10. Water Restrictions and Force Majeure

We reserve the right to alter or amend a published cruising route (or routes) if this is made necessary by canal stoppages, water shortages, flood, or if we deem this to be in the best interests of our passengers. You shall have no claim on us, and no particular right of cancellation, should any re-routing be necessary. Whilst we make every effort to keep to the advertised timetable, we shall not be liable for any loss caused to you by delay, mechanical or electrical breakdown, failure to keep to time, or any cause whatsoever. Should navigational difficulties prevail on the waterway, the cruise may be rescheduled to commence, divert or terminate at alternative locations. This situation will not be considered grounds for cancellation of a confirmed holiday.

We shall not be liable for matters arising beyond our reasonable control due to negligence or wilful default including without limitation, death or personal injury of yourselves, your crew and/or passengers, loss or damage to property, non-fulfilment or interruption of the reservation, delays, breakdowns, mechanical problems, defects, damage, restrictions on cruising, obstructions, repairs to waterways, non-availability of routes, storms, floods, drought, ice shortage of water and other weather conditions, non-availability of fuel, or in respect of any loss, damage, expense, injury or claim.

We can accept no liability for any delays or non-completion of planned cruising caused by restrictions, obstructions, or repair to the waterways system or any unforeseen cause. The company reserves the right to restrict the cruising area without prior notice should any unusual or hazardous conditions prevail.

11. Insurance

All guests are responsible for the decision whether to take out insurance to cover medical problems, cancellation charges and curtailment costs and other general matters.

We maintain Professional Indemnity Insurance.

In accordance with the terms of our Insurance policy, guests accept that whilst on-board the British Marine Federation Terms of Business apply.

12. General Conditions

No more than 4 people can stay on board overnight at any time.

Guest arrival time on day of embarkation is advised at time of booking.

Guest departure time is also advised at time of booking. This is to allow guests notice to organise travel home and give us time to prepare the boat for the next guests.

Safety Rules on board are for the safety and security of guests and others. You accept to observe these rules at all times. A copy is available on request and is displayed on board.

Fishing can take place from the boat providing that you hold a full Rod Licence for at least the period of your holiday and that the boat is moored. The client must ensure that this is not in a private fishing area. Live-bait is NOT ALLOWED on the boat at any time and at no point can any fishing bait be stored in the fridge.

Pets are not allowed unless otherwise agreed in writing.

Hirers must leave the vessel as they received it, in a clean and tidy condition and having checked that all items on the inventory are still on board by no later than 10.00a.m. on the last day of your charter. Please remember that the end of your holiday may well be the start of someone else’s and that they deserve to receive the boat in the same condition as yourselves.

All damages and breakages must be reported as soon as is safely possible to the Skipper of the vessel.

Nothing in these Terms and Conditions affects your Statutory Rights.  The contract between us is governed by the laws of England and Wales
